DA HOGAN FIGHTS OBSTRUCTION OF JUSTICE CLAIMS IN FEDERAL COURT
Chester County District Attorney Tom Hogan’s Facebook response to Rise & Shine Publishing Incorporated’s advertising landed DA Hogan, Chester County and West Chester Borough in Federal Court fighting a Federal Civil Rights case including claims of discrimination, defamation of character and a civil rights conspiracy. Rise & Shine Publishing Incorporated’s advertising stated in part that “DA Hogan was hiding the abuse of a child” and instead of directly responding to the information within Rise & Shine Publishing’s advertising, the DA Hogan Facebook page claimed to “have no idea” why a Rise & Shine Publishing employee was “doing this”. DA Hogan’s fight to prevent juvenile records from being obtained began in July of 2014 with DA Hogan claiming a subpoena requesting documents including an individual’s own file and public records was “overly burdensome” and “unreasonable”. While DA Hogan was claiming he had no idea why Rise & Shine Publishing Incorporated was advertising in West Chester, PA, DA Hogan and Chester County were refusing to schedule hearings on private criminal complaints pursuant to PA Rule of Criminal Procedure 506(A)(2) against mainly Chester County employees, West Chester Police Officers and former West Chester District Judge, Dawson R. Muth who told his client and his client’s 4 year old child to “get the fuck out of here (his office)” when Muth was served with a document requesting documents Muth made sworn statements indicating he had at his office, but then refused to give to his client. THE DAILY LOCAL NEWS DEFIES WEST CHESTER BOROUGH'S ANTI-DISCRIMINATION ORDINANCE
ON DECEMBER 16, 2018 THE DAILY LOCAL NEWS SOLD NEWSPAPERS FROM WEST CHESTER, PA LOCATIONS, INCLUDING THE 7-11 DA TOM HOGAN STATED BARRY BAKER ASSAULTED A DISABLED MAN. THE DAILY LOCAL NEWS ALSO SOLD ACCESS TO THEIR DIGITAL WWW.DAILYLOCAL.COM WEBSITE FROM WEST CHESTER, PA BOROUGH LOCATIONS ON DECEMBER 16, 2018
ON JANUARY 18, 2019 WEST CHESTER, PA POLICE CHIEF SCOTT BOHN, MAYOR DIANE HERRIN, BOROUGH MANAGER MICHAEL COTTER AND THE DAILY LOCAL NEWS WERE WARNED THAT THE DAILY LOCAL NEWS WAS VIOLATING PA THEFT BY DECEPTION LAWS IN AN EMAIL THAT STATED IN PART:
"The only legal way for the Daily Local News to sell newspapers in the West Chester, PA Borough is to publish paid advertisements without discriminating against customers or explain to Daily Local News customers that the Daily Local News is actually a "newsletter", not a"newspaper" and the information being published has been censored by politically motivated editorial practices. Without a disclosure to Daily Local News customers regarding the censorship of materials, including paid advertisements, the Daily Local News is in violation of PA theft by deception laws and is liable for damages in a class action fraud law suit. The Daily Local News is currently selling newspapers in West Chester Borough with a published, unretracted claim to “provide their customers a complete news package on multiple platforms" and published their writer, Andy Hachadorian's claims that "I have always stood up for the underdog, the little guy, for those whose voices need to be heard over the bullying tactics of those in charge, those with the power. I stand behind anyone who demands to be heard within the laws of our land". In other words, the Daily Local News is in violation of PA theft by deception laws and West Chester, PA Borough’s Anti Discrimination Ordinance."
